PAIA Manual

The Guide published by the Information Regulator

The Information Regulator has compiled a guide, in terms of section 10 of the Act, containing information reasonably required by a person wishing to exercise a right under the Act. It is available from the Information Regulator (South Africa) at enquiries@inforegulator.org.za and on the Regulator’s website.

Records held

Records held in the course of operating the road include: toll transaction and Frequent User account records; road status, closure and incident records; traffic volume statistics; maintenance, engineering and rockfall-monitoring records; concession, procurement and supplier records; employment records; and financial and statutory records.

Certain records are available without a formal request — gazetted tariffs, published road notices and general operating information are published on this website.

How to request a record

A request must be made on the prescribed form and delivered to the Information Officer at the address above, together with the prescribed request fee where applicable.

The request must provide sufficient particulars to identify the record and the requester, state the form of access required, and — where the request is made in order to exercise or protect a right — identify that right and explain why the record is required.

A decision will be conveyed within 30 days, which period may be extended in the circumstances permitted by the Act. Where a request is refused, reasons will be given together with details of the remedies available, including internal appeal where applicable and application to a court or the Information Regulator.

Fees

Request and access fees are those prescribed under the Act and are payable in the circumstances the Act provides for. A requester will be notified of any deposit required before a record is prepared.

Grounds for refusal

Access may be refused on the grounds set out in Chapter 4 of the Act, including the mandatory protection of the privacy of a third party, commercial information of a third party, confidential information, and records privileged from production in legal proceedings.
